), mobile application, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 16 years of age in the European Union or 13 years of age elsewhere to use the Services.

If you are under 18, you confirm that you have permission from a parent or legal guardian.

You represent that you are legally capable of entering into a binding agreement.

2. Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and up-to-date information

• Keep your login credentials confidential

• Notify us promptly of any unauthorised use of your account

You are responsible for all activity that occurs under your account. We are not responsible for losses resulting from unauthorised access caused by your failure to protect your credentials.

We may suspend or terminate accounts where reasonably necessary to protect the Services, other users, or to comply with legal obligations.

You agree to use the Services only for lawful, personal, and non-commercial purposes.

• Use the Services in a way that is illegal, harmful, or fraudulent

• Upload content that is unlawful, offensive, or infringes third-party rights

4. Golf, Fitness, and Health Disclaimer

ApexGolf is designed to support golf improvement and general fitness planning only.

• The Services do not provide medical advice and are not a medical device.

• Any training, fitness, or physical activity recommendations are general in nature.

• You should consult a qualified professional before beginning any new exercise or training programme.

Golf and physical activity involve inherent risks. You acknowledge and accept that you participate at your own risk.

Stop any activity immediately if you experience pain, dizziness, or discomfort.

5. No Guaranteed Results

We do not guarantee any specific golf, fitness, or performance outcomes. Results vary based on individual effort, ability, consistency, and external factors.

6. Intellectual Property

All content, software, features, and branding within the Services are owned by ApexGolf or its licensors and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial use only.

You may not copy, modify, distribute, sell, or create derivative works from the Services without our prior written permission.

7. User Content

You retain ownership of any content you upload to the Services.

By uploading content, you grant ApexGolf a limited, worldwide, royalty-free licence to store, process, and display that content only within the Services and only to you, as required to provide and improve the Services.

We do not sell, share, or use user-uploaded content for advertising, promotional materials, or public display. Any use of your content outside the normal operation of the Services would only occur with your explicit permission.

You represent that you have the rights to any content you upload and that it does not infringe third-party rights.

8. Subscriptions and Payments

Some features may require a paid subscription.

Where applicable:

• Subscription details, pricing, and billing terms will be displayed in the App

• Subscriptions may auto-renew unless cancelled before the renewal date

• Payments are charged in advance via the applicable app store or payment provider

• Cancellation takes effect at the end of the current billing period

Refunds are handled in accordance with applicable law and the policies of the relevant app store or payment provider.

9. Third-Party Services

The Services may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk.

10. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free operation of the Services.

11. Limitation of Liability

To the maximum extent permitted by law:

• ApexGolf shall not be liable for indirect, incidental, special, or consequential damages

• We are not liable for injuries, health issues, or losses arising from physical activity or reliance on the Services

• Our total liability to you shall not exceed the amount you paid to ApexGolf in the 12 months preceding the claim, or €100, whichever is greater

Nothing in these Terms limits liability where such limitation is not permitted by law.

12. Termination

You may stop using the Services at any time and delete your account.

We may suspend or terminate access where reasonably necessary due to:

• Breach of these Terms

• Fraudulent, abusive, or unlawful activity

• Legal or regulatory requirements

Upon termination, your right to use the Services ceases immediately.

13. Governing Law

These Terms are governed by the laws of Ireland.

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Changes to These Terms

We may update these Terms from time to time. When we do:

• Continued use of the Services constitutes acceptance of the revised Terms
